1. Acceptance of Terms

By downloading, installing, or using MoveFirst (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

MoveFirst is a fitness-driven screen time management application for iOS. The App rewards completed workouts with screen time that can be spent on apps you choose to restrict. The service includes:

  • Workout detection via Apple HealthKit (supporting workouts recorded by any HealthKit-connected fitness app or device)
  • Screen time reward calculation based on your activity
  • App blocking via Apple's Screen Time APIs (FamilyControls, ManagedSettings, DeviceActivity)
  • Streak tracking and fitness insights

3. Eligibility

You must be at least 18 years old to use MoveFirst. You must have a compatible iOS device with HealthKit and Screen Time capabilities. By using the App, you represent that you meet these requirements.

4. Account Registration

Full functionality requires signing in with Apple. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must provide accurate information when creating your account.

5. Health and Fitness Disclaimer

MoveFirst is not a medical device, health monitoring tool, or fitness adviser.

The App does not provide medical advice, diagnoses, or treatment recommendations. Workout detection and reward calculations are based on data reported by Apple HealthKit and connected fitness apps. We do not independently verify the accuracy of this data.

You should consult a healthcare professional before starting or modifying any exercise programme. MoveFirst is not responsible for any injury, health issue, or adverse outcome related to exercise you perform while using the App.

The reward system is designed to encourage physical activity but should not override your own judgement about safe exercise levels. If you experience pain, discomfort, or any health concerns during exercise, stop immediately and seek medical attention.

6. Screen Time Controls Disclaimer

MoveFirst uses Apple's FamilyControls, ManagedSettings, and DeviceActivity frameworks to manage app restrictions on your device.

  • Screen time controls are provided as a voluntary self-discipline tool. They are not intended to replace parental controls, accessibility features, or any medically prescribed device usage limitations.
  • You can always override or disable app restrictions through the MoveFirst App.
  • We are not responsible for any consequences of blocked access to apps, including missed communications, emergency situations, or inability to access critical services.
  • You should ensure that essential apps (Phone, Messages, emergency services, health-critical apps) are not included in your blocked app selection.
  • Screen time restrictions are managed locally on your device. We cannot remotely lock or unlock your apps.

7. Acceptable Use

You agree not to:

  • Manipulate, fabricate, or falsify workout data to fraudulently earn screen time rewards
  • Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App
  • Use the App for any purpose that violates applicable laws or regulations
  • Attempt to circumvent any security features or access restrictions of the App

8. Third-Party Services

MoveFirst integrates with Apple HealthKit and Apple Screen Time APIs. Your use of these Apple services is subject to Apple's terms and conditions. All workout data is read through Apple HealthKit. We do not maintain direct API integrations with third-party fitness platforms.

We are not responsible for the availability, accuracy, or functionality of Apple's services. If Apple's services are unavailable, certain MoveFirst features may be temporarily limited.

9. Intellectual Property

MoveFirst and its original content, features, and functionality are owned by MoveFirst and are protected by applicable intellectual property laws. The MoveFirst name, logo, and brand assets are trademarks of MoveFirst. You may not use our trademarks without prior written consent.

10. Subscription and Payment

MoveFirst is currently free to use. We reserve the right to introduce premium features or subscription plans in the future. Any paid features will be clearly communicated before purchase, and you will never be charged without your explicit consent.

11. Limitation of Liability

MoveFirst is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by applicable law, MoveFirst shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim, or AUD $50, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless MoveFirst and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using MoveFirst at any time by deleting your account through the App's settings and uninstalling the App.

Upon termination, your data will be deleted in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination (including liability limitations and indemnification) will continue to apply.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App or via email. Your continued use of MoveFirst after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the courts of Australia.

If you are accessing the App from outside Australia, you are responsible for compliance with local laws to the extent they apply. If any provision of these Terms is found to be unenforceable under the laws of your jurisdiction, the remaining provisions shall continue in full force and effect.
